PRESIDENT ROBAK:  Return to LB 1219.

CLERK:  (LB) 1219 Madam president, Senator Willhoft, you have the first amendment to the bill.  I understand you want to withdraw that Senator, is that right?

PRESIDENT ROBAK:  The amendment is withdrawn.

CLERK:  Senator Bohlke would move to return the bill for AM4515, Madam President.  (AM4515 is found on pages 1871-72 of the

Legislative Journal.)

PRESIDENT ROBAK:  Chair recognizes Senator Bohlke to open on her motion to return.

SENATOR BOHLKE:  Yes, thank you, Madam President and members.  Currently you have the amendment being passed out, distributed to you.  There was pointed out to us by the Department of Education a problem that we have with current language in two bills that we need to correct with this amendment on this bill.  If you remember, LB 1134 was Senator Ray Janssen's bill and in that bill we stated that we would reduce the TEEOSA Fund by $2 million.  At the same time Senator Wickersham amended LB 1175, which implemented a new method for determining the appropriate amount of funds for TEEOSA.  So this creates a conflict that we need to resolve with the amendment that should be placed on your desks and it removes the language that creates the conflict.  It removes the language that you see right at the bottom of page 1.  Page 1.  Sorry, this was just pointed out to us not long ago and recognized the need to make the correction.  Informed Senator Coordsen about it, Senator Wickersham and hope that we can do this and move the bill along.  So for that, I ask you to return the bill to Select File.

PRESIDENT ROBAK:  Thank you, Senator Bohlke.  Senator Jim Jensen announces that the following guests are visiting the Legislature today, Lois Eaton, Mary Ann Nielsen and Loraine Hooks are all here and they are Senator Jensen's sisters.  They are all seated under the south balcony.  Welcome.  Senator Beutler.

SENATOR BEUTLER:  Senator Bohlke, just a quick question.  This amendment doesn't change the amount that has been allocated for incentives in any way, and the money is transferred in and transferred back, it is all the same, right?

SENATOR BOHLKE:  Right.

SENATOR BEUTLER:  Okay, thank you.

PRESIDENT ROBAK:  Thank you, Senator.  Any further discussion?  Seeing none, Senator Bohlke to close on her motion to return.  Closing is waived.  The question before you is the motion to

SENATOR BOHLKE:  Thank you, Madam President and members, really I explained the amendment in asking you to return the bill.  It is recognizing a conflict that appears in two other bills and allowing us to resolve that with a change in the removal of the wording that is in the amendment before you.  Thank you.
